Abstract
This article deal with idea of social welfare and appropriate rights in Iran. As you know, Social welfare has been a controversial concept in the economic and political schools. In Iran we did not observe any institutional welfare services in the past. The kings had authority to give some relieves to poor and needy people. After the revolution, the Constitution demonstrated an image of social welfare by declaration of welfare rights. Unfortunately, there are no sanctions for these rights in the Constitution and other laws. In addition, we have a long way for changing mind of the judiciary and judges about application of welfare rights. Ratification of Comprehensive Structure of Welfare and Social Security System Act was a step forward to harmonize social welfare policies and build a framework to substantive rules of social welfare systems. Although this Law recognizes right to social security for the public but does not entitle them to lodge a claim in courts on disputes pertaining to social welfare rights against state. So we are in need of having a jurisprudence about it.
