The Analysis of Parliament’s Chief Supervision Mechanism on the Executive Power Regulations

Abstract
Supervision and control of power is considered an appropriate mechanism to guarantee the rights and civil liberties, government efficiency and political system based on democracy and the rule of law. In this regard, the executive power due to applying the sovereignty has the authority to regulate the public rules that is very necessary. One of the most important control mechanisms over the executive power regulations in public law, is the parliament chief supervision in accordance with Article 85 and 138 of the constitution that the scope and the exercise of such authority in the legal system of the Islamic Republic of Iran is faced with ambiguities and challenges.
The consequences are indicated that such supervision is justified on the principles of democratic system and is not compatible with the principles and fundamental rules of public law and the supervision implementation mechanisms faced with the serious challenges. Therefore, it is necessary to design a supervision preferable system on the executive power regulations.
