The main function of the rule of law is to establish an unbreakable relationship with the concept of the constitution-the attainment of power and securing the rights and freedoms of individuals. Hence, the assessment of the concepts of rule of law in the proceedings of Iran Constitution 1979 is of increasing importance in the history of contemporary Iranian constitutional law. From the relatively new term of the rule of law, many concepts and perceptions are extracted. For this reason, so far, various and numerous interpretations and meanings from the rule of law have been inferred and presented. The minimalistic concept is the most abstract and most appropriate definition. The law-governed government and its opposite, law enforcement government, are the concept of law as value and the conceptual and material conception of other important concepts which are expressed primarily by the philosophers of law from the rule of law. The definition of these concepts and their critical adjustment with speeches and readings described in proceedings of Iran Constitution 1979 constitutes an analytical-descriptive as well as comparative research which is performed in this paper with reference to the basic resources. مشروح مذاکرات قانون اساسی سال 1358 چنان که باید در منابع و پژوهش­های حقوقی نوین پس از تصویب و اجرایی شدن قانون اساسی مورد بررسی نقادانه و تحلیل فلسفی حقوق قرار نگرفته است. کار­‌‌‌‌‌ویژه اصلی حاکمیت قانون ارتباط ناگسستنی با مفهوم قانون اساسی، تحدید قدرت و تضمین حقوق و آزادی­های افراد برقرار می‌کند. از این رو ارزیابی مفاهیم حاکمیت قانون در مشروح مذاکرات 1358 اهمیت افزونی در تاریخ حقوق اساسی ایران معاصر دارد. از اصطلاح نسبتاً جدید حاکمیت قانون مفاهیم و برداشت‌های متعددی مستفاد می‌شود. به همین دلیل تاکنون قرائت‌ها و معانی متکثر و گوناگونی از حاکمیت قانون استنباط و ارائه شده است. مفهوم حداقلی خلاصه‌ترین و مناسب­ترین تعریف است. دولت حقوقی و دولت مقابل آن، انتظامی، مفهوم قانون به مثابه ارزش و برداشت شکلی و ماهوی سایر مفاهیم مهمی هستند که عمدتاً توسط فلسفه­پردازان حقوق از حاکمیت قانون بیان شده‌اند. تعریف این مفاهیم و تطبیق انتقادی آن‌ها با گفتار‌ها و قرائت‌های گفته شده در مشروح مذاکرات قانون اساسی 1358 پژوهشی تحلیلی-توصیفی و نیز انطباقی است که در این مقاله مستند به منابع بنیادین انجام خواهد شد. https://www.asasimag.ir/article_95253_7eb87a2017e110be6c83f22e13e0c71c.pdf
