Public order is used in both broad and narrow meanings. But most jurists accept its full generality. A generality that indicates its inclusion in all matters of public and private law and in any public place and to the general public. Public order is fed by both codified and non-codified sources. Its codified source is the laws and regulations of the subject and its non-codified sources include the legal principles and foundations of the cultural, social and political life of a society; Although it is not mentioned anywhere in the rules and regulations. Codified sources themselves, in most cases, have referred to non-codified sources in the form of references to custom and lack of examples. The category of public order is active in regulating the freedom of assembly and organization; Which is briefly discussed in this article. آنچه همواره در قبال آزادی به مثابه سدی عرض اندام کرده و هر جا به شکلی خودنمایی نموده و نامی بر خود نهاده است تا بتواند آزادی را محدود و فرد را در مقابل جامعه و دولت از تحرک دلخواهش باز دارد، چیزی جز نظم عمومی - در معنای موسع آن - نبوده است. نظم عمومی در دو معنای موسع و مضیق به کار برده شده است. اما اکثر حقوقدانان عمومیت کامل آن را قبول دارند. عمومیتی که بیانگر شمول آن بر تمام موضوعات حقوق عمومی و خصوصی و در هر مکان عمومی و بر عموم مردم است. نظم عمومی از دو منبع مدون و غیر مدون تغذیه می شود. منبع مدون آن عبارت از قوانین ومقررات موضوعه است و منابع غیر مدون آن شامل اصول حقوقی و مبانی حیات فرهنگی، اجتماعی و سیاسی یک جامعه است ؛ اگر چه در جایی از قوانین ومقررات قید نشده باشد. منابع مدون نیز خود دراغلب موارد،پای منابع غیر مدون را به صورت ارجاع به عرف وعدم احصاءمصادیقبه میان کشیده اند. مقوله نظم عمومی درتنظیم آزادی تجمع و تشکل حضوری فعال دارد ؛ که در این نوشتار مختصراَمورد بحث قرار میگیرد.
