In some cases, the presented interpretation of fundamental rights is in accordance with ensuring fundamental rights for the majority of people in a society; that is, fundamental rights are to support and defend the idea of the majority in the society in running the society and legislations which affect the society. It appears that this case could be mostly observed in parliamentary systems. However, it seems that this form of interpretation from this aspect of fundamental rights was acceptable and functional until late twentieth century and these forms of interpretation could not be fulfilled in the last decade of the twentieth century. According to public law scholars in the new era, although fundamental rights are to support and defend the idea of the majority in the society in running the society and legislations, it has to prevent the majority from overrunning the rights of the minority in the society; that is, it has to support the rights of the minority, as well. Hence, its realm includes supporting and defending the fundamental rights of not only the majority, but also the minority in a society. In other words, it equally supports and defends all individuals fundamental rights, both majority and minority. In fact, it supports the political equality for all individuals and does not safeguard the public interest, only. }, keywords = {fundamental rights,Constitution,Democracy,individuals’ fundamental rights and freedoms,the rule of law}, title_fa = {حقوق اساسی و نقش آن در شکل گیری مدل دموکراسی}, abstract_fa = {یکی از عمده ترین وظایفِ حقوق اساسی به عنوان ایجاد کننده ی ساختار سیاسی، حقوقی، اقتصادی، اجتماعی و فرهنگی هر کشور، تضمین حقوق و آزادی های اساسی و عمومی افراد می‌باشد. در برخی اوقات، تفسیری که از این وجهِ حقوق اساسی ارائه می شود، بیشتر با حمایت حقوق اساسی از حقوق اکثریت افراد در جامعه هم راستا می‌باشد. به عبارت دیگر و بر اساس این گونه تفسیرها، حقوق اساسی وظیفه ی حمایت و دفاع از نظر اکثریت جامعه را در روند اداره کردن جامعه و وضع قوانینی که بر جامعه حکم فرماست، به عهده دارد. چنین به نظر می رسد که این وضعیت بیشتر در نظام های پارلمانی قابل مشاهده است. اما به نظر می رسد که این تفسیر از این وجه حقوق اساسی تا  اواخر قرن بیستم کارگر و قابل قبول بوده است و این گونه تفسیرها از دهه ی آخر قرن بیستم به این طرف قابل ارائه و انجام نمی باشد. بر اساس اندیشه های اندیشمندان حقوق عمومی در عصر جدید، حقوق اساسی هر چند که وظیفه ی حمایت از نظر و آرای اکثریت افراد جامعه را دارد، اما وظیفه ی جلوگیری از تجاوز اکثریت به حقوق و آزادی های اساسی و بنیادین افراد در اقلیت جامعه را نیز دارد و یا به بیان دیگر، وظیفه ی تضمین و حفظ حقوق اقلیت را نیز دارد. از این رو، گستره ی پشتیبانی و حمایت حقوق اساسی نه تنها اکثریت، بلکه اقلیت یک جامعه را نیز شامل می شود. به بیان دیگر، حقوق اساسی تمامی افراد یک جامعه را، اعم از اکثریت و اقلیت، به شکل برابر مورد حمایت و پشتیبانی قرار می دهد و در اصل خود را ملزم به برابری سیاسی همه ی افراد می داند و تنها منفعت همگانی یا خیر همگان را مد نظر قرار نمی دهد.}, keywords_fa = {حقوق اساسی,قانون اساسی,دموکراسی,حقوق و آزادی های اساسی و بنیادین افراد و حاکمیت قانون}, url = {https://www.asasimag.ir/article_104993.html}, eprint = {https://www.asasimag.ir/article_104993_75ffbbd0d61eb15af0d2dbda0e1e6dda.pdf} }
