Despite of some legal arguments based on principles of theConstitution provided by the lawyers regarding exclusion of investigating the qualifications of the candidates from general control, it seems that the philosophy of thecontrol on elections makes it necessary that Guardian Council's control also be exerted on investigating the qualifications of the candidates. Despite of expression to approbative control, Guardian Council's procedure in investigating Parliament's statutes in many cases indicates Guardian Council's shift from approbative to legal control. The lawyers' arguments justifying the legal control are more legitimate than those justifying approbative or informative control. In the view of Guardian Council, thecontrol on elections is obligatory, and, such legislations as appointing some Controllers - including person, authority or agency- along with Guardian Council, appointing an agency reviewing Guardian Council's opinions, constraining Guardian Council's jurisdiction, and specifying the criteria other than absolute majority for pronouncing, all of these, are contrary to principle 99 of theConstitution.}, keywords = {Control,elections,Guardian Council,Approbative Control,Constitutional Interpreter,Constitutional Controller}, title_fa = {تأملی بر اصل99قانون اساسی از منظر شورای نگهبان}, abstract_fa = {بررسی نظریات شورای نگهبان در مقام مفسر و ناظر اساسی نشان می دهد که نظارت مذکور در اصل99قانون اساسی«عام»، «استصوابی»، «الزامی»، «انحصاری»، «قطعی و نهایی»، «نافی محدودیت‌های غیرضرور قانونی» و با«ملاک اکثریت مطلق در رای‌گیری» است. به رغم برخی استدلال‌های حقوقدانان مبتنی بر اصول قانون اساسی در خصوص عدم تسری نظارت عام به مرحله تایید و رد صلاحیت داوطلبان به نظر می‌رسد فلسفه نظارت بر انتخابات اقتضا دارد که نظارت شورای نگهبان بر رسیدگی به صلاحیت داوطلبان نیز اعمال گردد. شورای نگهبان اگرچه به استصوابی بودن نظارت تصریح داشته است اما مشی این نهاد در بررسی مصوبات مجلس در بسیاری از موارد نشان از عدول از نظارت استصوابی به نظارت قانونی دارد. استدلال­های حقوقدانان در خصوص قانونی بودن نظارت دارای وجاهت بیشتری در مقایسه با استدلال‌های موافقان نظارت استصوابی یا نظارت استطلاعی است. شورای نگهبان نظارت بر انتخابات را الزامی می­داند و در حوزه نظارت بر انتخابات، تعیین شخص، مقام یا نهادی در کنار شورای نگهبان، پذیرش نظر مرجعی مافوق نظرات شورای نگهبان، اعمال محدودیت بر صلاحیت شورای نگهبان و تعیین ملاکی غیر از اکثریت مطلق برای اعلام نظر را مغایر با اصل99قانون اساسی اعلام نموده است.}, keywords_fa = {نظارت,انتخابات,شورای نگهبان,نظارت استصوابی,مفسر اساسی,ناظر اساسی}, url = {https://www.asasimag.ir/article_100928.html}, eprint = {https://www.asasimag.ir/article_100928_7f3fb608eddae8b10f5d7f46e0cfc7ca.pdf} }
