A Consideration on Disturbance Objection of Legitimate Expectation Principle with Some Administrative Law Principle

Legitimate Expectations are the same as citizens’ reasonable expectations which results from leaning to public officials’ decisions and definite representations in discretionary powers framework are that can be ruined by a rejection or annulations through new decisions and representations.
Despite the acceptance of this principle in the law system of some developed countries, unfortunately in some other countries, using this principle in administrative claims is in disturbance of executing some of other administrative law traditional principles such as “Separation of Powers Principle”, “legal Administration Principle”, “Administration Efficiency Principle”, “Principle of No-Fettering”, “Principle of No-Harm to Third Parties” and “Principle of No-Making Unreal Expectations” and due to this reason, discovering its identity has been avoided. A consideration in related reasons to legitimate expectation disturbance with other administrative law principles, perfectly shows that observing this principle, not only is not an obstacle for executing mentioned principle, but also is profitable and suitable in facilitating and accelerating their execution.
This paper has been worked on investigating and criticizing the disturbance objection of legitimate expectation as a legal principle with some other administrative law principles.

The Role of the Internet in Public Participation for Environmental Protection and Management

With impressive expansion and proliferation of telecommunication and computer technologies, decision makers, advocates, and the broader public are turning to the Internet to obtain information, share information, coordinate campaigns, and engage in policy and project-specific discourses. The Internet is changing how decisions are made and who is involved in the process. Therefore, it is vital to consider the role of Internet in comparison to other telecommunication means and see the fundamental differences. This revolution has spread to the management and protection of the environment and environmental problems in the 21st century.
The first part of this study will explore the importance of information sharing, public participation and transparency as fundamental principles from the perspective of international environmental law. It also focuses with an overview of the types of the Internet-based tools and ways that promote public access to information and public participation in environmental issues which led to more transparency in the decision making processes and also clarification of the important decisions for the potentially injurious projects on the environment. We will also briefly consider the advantages and disadvantages of the Internet-based tools and their role in dissemination of information.
We also review the different Internet-based approaches for sharing information the ways through which Internet can bring about more democratic environmental policy-making processes. This article closes with some thoughts on future developments of the Internet and the extent to which it can engage civil society in the protection of the environment.

Au cours de la dernière décennie, l’émergence d’une force et d'une demande sociale ont amené le gouvernement à s'attacher à l’application de la Constitution. C'est ainsi qu’une institution a été mise en place afin de surveiller l’application de la Constitution et les atteintes à cette dernière. Quand cette institution a trouvé ses limites dans ses moyens d’agir, en l’absence d'un équilibre des forces, un nouveau concept politico-juridique est apparu chez les hommes politiques, qui allait au-delà de la dimension juridique de l’application de la Constitution ; un concept qui, pour expliquer la question, ne se limitait pas aux termes et au langage du droit. L'apparition de ce concept nous a rappelé que la Constitution en tant que phénomène multidisciplinaire ne se réduit pas à la simple dimension du droit. Jusqu'ici, le droit constitutionnel iranien ne se disposait pas de concept pour expliquer, d’une manière méthodique, la condition de possibilité de l’application de la constitution. C'est par ce biais que nous allons étudier l’histoire constitutionnelle de l’Iran, afin d'aborder autrement la condition de l’application de la constitution. A travers ce concept nous envisageons de réorganiser les matières historiques concernant l’application de la Constitution. Nous allons proposer l’introduction de ce concept dans l’étude de la Constitution et du droit constitutionnel. Nous somme convaincu que le droit constitutionnel iranien doit repenser les limites des termes juridiques pour expliquer les questions qui concernent la Constitution, et par cette observation introduire un langage plus adapté dans les études constitutionnelles, qui ne se réduise pas à une langue formelle. Un tel concept pourra permettre de relever certains défis. Selon nous le fait de ne pas avoir donné une place favorable à un tel concept de la constitution a eu des effets néfastes sur l’état du développement du droit constitutionnel en Iran.
