This issue has special features in Iranian law due to the Islamic nature of the system. On the one hand, according to Islamic standards, no official enjoys immunity, and the legislature has emphasized the principle of equality of the people before the law. On the other hand, it is necessary that some people working in sensitive jobs should have job security in order to perform their duties well and maintain their job independence. An examination of how to resolve this conflict in Iranian law shows that international holders of occupational immunity, including heads of state and other government officials, diplomatic and consular agents, and agents and employees of international organizations in Iranian territory, in accordance with Iranian Islamic traditions and international obligations. They enjoy the same immunity as their counterparts in other countries. These immunities are provided in the form of immunity from aggression, immunity of residence and private property, and judicial and executive immunity. In contrast, internal holders of immunity face limitations due to the Islamic nature of the system. Due to the emphasis of the holy Sharia of Islam and domestic laws, including the constitution on the equality of individuals before the law, there is no administrative immunity for the leader, the president and other government officials. However, for some groups of people, including members of parliament, judges and lawyers, some job security is provided. Parliamentary immunity in Iran is in the position of defense only in the form of irresponsibility in expressing opinions and votes, immunity of judges in the form of prohibition of dismissal and transfer of these people without their consent and immunity of defense lawyers in the form of having the same respect and security of judges.  }, keywords = {Occupational immunity,Diplomatic immunity,Administrative immunity,Parliamentary immunity,Judges' immunity}, title_fa = {مصونیتهای شغلی در حقوق ایران}, abstract_fa = {  یکی از مسائل مهم مورد بحث در رشته حقوق عمومی مبحث مصونیتهای   شغلی است.  این مبحث در حقوق ایران بدلیل اسلامی بودن نظام از ویژگیهای خاصی برخوردار می باشد. از یک طرف، بر اساس موازین اسلامی، هیچ مقامی از مصونیت برخوردار نیست و قانونگذار براصل تساوی مردم در مقابل قانون تأکید نموده است. از طرف دیگر، لازم است که بعضی افراد شاغل در مشاغل حساس،باید برای حسن انجام وظایف و حفظ استقلال شغلی خود، از مصونیت شغلی برخوردار باشند. بررسی چگونگی حل این تعارض  در حقوق ایران نشان می دهد که دارندگان بین المللی مصونیت شغلی از جمله ،روسای کشورها وسایر مقامات حکومتی، مأموران دیپلماتیک و کنسولی و مأموران و کارمندان سازمانهای بین المللی در قلمرو ایران، بر اساس سنتهای اسلامی و تعهدات بین المللی ایران از مصونیتی مشابه با همقطاران خود در قلمرو سایر کشورها برخوردار شده اند. این مصونیتها به صورت مصونیت از تعرض، مصونیت محل اقامت و اموال خصوصی و مصونیت قضائی و اجرائی پیش بینی شده است. در مقابل، دارندگان داخلی مصونیت، بدلیل اسلامی بودن نظام با محدودیتهائی روبرومی باشند. با توجه به تأکید شرع مقدس اسلام و قوانین داخلی از جمله قانون اساسی بر برابری افراد در مقابل قانون، برای رهبر، رئیس جمهور و سایر مقامات حکومتی مصونیت اداری وجود ندارد. لیکن برای سه گروه از افراد ازجمله نمایندگان مجلس، قضات و  وکلای مدافع تا حدی مصونیت شغلی پیش بینی شده است. مصونیت پارلمانی درایران صرفا به صورت عدم مسئولیت در اظهار نظر و رأی، مصونیت قضات به صورت  منع عزل وانتقال و تغییرشغل این افراد بدون رضایت آنان و مصونیت وکلای مدافع به صورت برخورداری از همان احترام وتأمینات قضات، در موضع دفاع است.}, keywords_fa = {مصونیت شغلی,مصونیت دیپلماتیک,مصونیت اداری,مصونیت پارلمانی,مصونیت قضات}, url = {https://www.asasimag.ir/article_126245.html}, eprint = {https://www.asasimag.ir/article_126245_807b71e5bed5472e7a67ae685b303f7b.pdf} }
