Therefore, the environmental degradation and pollution is not only despicable, but hazardous and costly as well and the public has a duty to protect it. In this regard, to have the environment protected from pollution and degradation due to reasons such as urban high population growth and the necessity to devise a settlement, urban and industrial wastes, destruction of forests and other natural resources, air pollution in large cities, many countries have enacted environmental laws and regulations in their legal systems and have established organizations, institutions and agencies devoted to the environmental protection. On the other hand, as the right to a healthy environment is one of citizenship rights linked integrally to the sustainable development, the enactment of legislation should, at a minimum, be in relation to the principles of sustainable development. The present research is an analytic and descriptive study using library resources including articles, books and other materials about the subject area. This study indicated that many laws have been approved in order to protect the environment, but they didn’t fully respect the foundations and principles of sustainable environmental development; so that some of these principles are considered at the standard-level by legislator, some have not been mentioned, and some others remained implicit by the legislator.}, keywords = {The right to a healthy environment,Human rights,Environmental Law,public rights}, title_fa = {بررسی حق بر محیط زیست سالم از منظر حقوق عمومی}, abstract_fa = {آینده حیات بشری، به داشتن محیط زیست سالم و به دور از هر گونه آلودگی بستگی دارد و نابودی محیط زیست، مساوی است با نابودی بشریت. بنابراین هر گونه تخریب و آلودگی محیط زیست مطرود بوده و حفاظت از آن وظیفه عمومی است. در این راستا، کشورهای گوناگون در نظام های حقوقی خود برای حفاظت از محیط زیستی که به دلایلی همچون افزایش روز افزون جمعیت شهرها و نیاز به سکونت، پسماندهای شهری و صنعتی، تخریب منابع طبیعی و درختان جنگلی، آلودگی آب و هوا در شهرهای بزگ، روز به روز در معرض تخریب و آلودگی قرار دارد، با تصویب قوانینی سازمان ها، نهادها و موسساتی را به امر حفاظت از آن اختصاص داده که در سطح قوای سه گانه وظایف و اختیاراتی را بر عهده دارند. از طرف دیگر از آنجا که حق بر داشتن محیط زیست سالم، مصداقی از مصادیق حقوق شهروندی که با توسعه پایدار در ارتباط کامل است، لذا قوانین تصویبی باید در ارتباط حداقلی با اصول توسعه پایدار باشند.  روش پژوهش حاضر تحلیلی- توصیفی وبااستفاده ازمنابع کتابخانه­ای ازجمله مقالات،کتب ومطالب نوشتاری درموضوع مورد بحث،صورت گرفته است. نتیجه تحقیق حاضر نشان دادکه قوانین متعددی در راستای حفاظت از محیط زیست تصویب شده است لکن به یک اندازه در ارتباط مانوسی و مطابقتی با مبانی و اصول اساسی توسعه پایدار زیست محیطی نبوده، بدین ترتیب که برخی از مبانی و اصول در سطح استاندارد مورد توجه قانوگذار اساسی و عادی قرار گرفته است و برخی از اصول بدان ها اشاره ای نشده است و برخی دیگر به شکل ضمنی نیز مطمع نظر قانونگذار قرار گرفته است.}, keywords_fa = {حق داشتن محیط زیست سالم,حقوق بشر,قوانین زیست محیطی,حقوق عمومی}, url = {https://www.asasimag.ir/article_118561.html}, eprint = {https://www.asasimag.ir/article_118561_596bd890e17b09cf922bef34562e3870.pdf} }
