The attention to the issue of nation's right in the contents of Iranian social studies school textbooks

This study examines the amount of attention to nation's right in the content of Iranian school textbooks. The right of the nation is a part of the human right recognized by the government in the constitution law. Therefore, it is expected that this issue is considered in formal school education.
Present research is conducted as a survey in two stages. The first stage includes the study of literature and basic principal of nation's right, and review the Iranian constitution law to deduce and extract the basic components of nation's right. The second phase includes analysis of curriculum content .In this stage the amount of content consistent with the fundamental components of nation's right were identified. Statistical population includes all social studies and sociology textbooks in formal school education that has been prepared by the Ministry of Education. Descriptive and inferential methods are used to analyze the results.
This study shows the current textbooks have not considered the nation's right as acceptable. Although some components, such as people's rights to participate in determining the future have been considered, but some basic individual and social rights such as freedom of thought are not considered adequately.

This Article, concentrating governmental torts, explores the conceptions and evoluation of immunity and liability of government in comparative prospective. The essay has been divided into two main part. First, it will present an conceptual and evolutionary analysis of both immunity and liability and in second part, the legal position that they have been captured will be discussed. The government must be entitled to govern free from liability. As a applicable rule It cannot be a liability for government to govern. However, when a government is supplying services, that is, doing things for its people other than governing, it should be subject to liability principle. Based on this It will be seen that all studied legal system have now rectified the immunity by passing legislation which leaves the "government" liable in large amount of its acts. Thus, the liability of the government is a relatively is prevailed to immunity.

L`ordre juridique est un ensemble des règles et des institutions qui sont en contact et aux prises. L`ordre juridique est un ensemble coordonne des règles et des institutions ayant une cohésion, un enchainement entre eux. Le changement et l`évolution dans un secteur de ces paramètres, influencent sur les autres secteurs. Dans un ordre juridique, certains des règles et des institutions peuvent compléter les inconvénients et les lacunes fonctionnels des autres. L`interpénétration du droit public et du droit prive est important de ce point de vue. Cependant, il faut signaler que la dualité juridique est tributaire de la dualité sur le fondement de la règle juridique. En acceptant le monisme sur le fondement, la dualité juridique n`aurait pas de place. Il est aussi nécessaire de signaler que la place de la dualité dans l`évolution de l`ordre juridique est inspirée par la finalité (individualisme, sociologisme juridique) de l`ordre juridique.

Today Knowledge covers all over actions and aspects of human life. It makes our age different from agricultural and industrial ages. However human’s life had been in company with knowledge but these days knowledge becomes more important than yesterday in business, economic and ensuring human’s needs.
In This age Human confronting whit many problems that are special for him/her and they’ve never been in past, for example climate changes, drought, incurable disease and shortage of energy, while our life is depended to it. Just knowledge can solve these problems, give answer tothem, ensure human life and help to his/her survival. Knowledge should be common and share because it is necessary for knowledge development and achieving to new answers for new problems. States need to knowledge for fulfill their human rights obligations. Knowledge monopoly by public or private entity is an obstacle for human rights ensuring. Therefor knowledge monopoly resulting in human rights violation.

Le droit public est un espace de dualité : la dualité de droit public-privé, la dualité de pouvoir-liberté, la dualité de l’acte de puissance publique-acte de gestion, la dualité entre la juridiction judicaire et administrative et enfin la dualité de la loi et règlement. D’une certaine manière, on pourrait tenter de dire que la dualité, ou si l’on vaut, la pluralité est un caractère intrinsèque de droit public. La plupart de ces dualités ont pour but de créer des garanties solides dans les rapports de l’Etat et citoyens.
Parmi toutes ces dualités, celle de la loi-règlement semble être plus importante à nos jours. Le volontarisme politico-juridique du Gouvernement actuel a fait resurgir l‘un des débats le plus passionnant du droit public classique qui est celui de la distinction entre la loi et règlement. Cette contribution va donc essayer de vérifier l’état de droit de la dite distinction en droit constitutionnel iranien.
